Domestic work refers to activities carried out by people to meet the needs of a household, such as child surveillance, care for the sick and elderly, cooking meals, washing and tidying clothes, cleaning the house, caring for domestic animals, gardening and sewing. All domestic workers are entitled to social protection, regardless of whether they work full-time or only a few hours a week. To ensure this right, employers must follow several legal obligations.

1. Employment Contract and Communication to Social Security

It is essential that the employment contract contains detailed information such as the identification of the employer and the employee, the duration of the service, the tasks to be performed, the place of work, the amount of remuneration and the rules for time off and vacations. The salary can be agreed upon by the hour, day, week, or month. Employers must officially notify Social Security of the admission of the domestic worker up to 15 days before the start of the service. This communication can be made in person, by email or via Social Security Direct. 2. Social security contributions

Contributions are calculated on the basis of the agreed remuneration. The employer can choose between two regimes:

  • Conventional regime: Calculated based on the social support index (509.26 euros in 2024). This value will be adjusted to 522.50 euros in 2025, resulting in a rate of 28.3%. For a monthly salary of €870 in 2025:
    • Total to pay: 246.81 euros

      • Employee: 11% = 96.90 euros

Regardless of the regime chosen, the employer must make payments between the 10th and the 20th of the following month and submit the Model 10 declaration annually on the Finance portal, detailing the amounts paid to the employee and the contributions delivered.

3. Workers’ Compensation Insurance

It is mandatory to take out workers’ compensation insurance to protect the employee from injuries during the provision of services or on the way from home to work. This insurance covers medical expenses, transport and disability compensation.

4. Domestic Workers’ Rights

Domestic workers have the right to:

  • Vacation: 22 working days per year, proportional to the length of service. In the year of admission, the employee is entitled to 2 working days for each month worked, up to a maximum of 20 days.
  • Holidays: They are entitled to rest on mandatory holidays. If they work on a holiday, they must receive compensation or a day of rest.

5. Termination of Agreement

Contracts may expire due to changes in the employer’s family life, requiring prior notice ranging from 7 to 30 days in advance, depending on the length of the contract.
